OFFICIAL RULES OF THE Azusa Pacific University/J.W. Pepper High School Composition Contest

SPONSORED BY Azusa Pacific University and J.W. Pepper and Son, Inc. (hereinafter referred to jointly as “Sponsor”). Azusa Pacific University’s principal place of business is 901 East Alosta Avenue, Azusa, California 91702. J.W. Pepper’s principal place of business is 191 Sheree Blvd., Exton, PA 19341.

 

  1. ELIGIBILITY: The Azusa Pacific University/J.W. Pepper High School Composition Contest for 2017-18 is open only to those legal residents of the fifty (50) United States, the District of Columbia, or US territories and individuals currently studying in one of the fifty (50) United States, the District of Columbia, or US territories pursuant to a valid F-1 Student Visa who are currently enrolledin an accredited secondary school or private secondary school, or are members of a home school association or cooperative. Students must supply contact information of an official of the school, association, or cooperative so that enrollment or membership can be confirmed. All minors who enter must have the written consent of a parent or legal guardian to be eligible to participate in the contest and to receive a prize if a contest winner. Applications for minors must be signed by a parent or legal guardian indicating the parent’s or legal guardian’s consent to the minor’s participation in the contest, as well as the parent’s or legal guardian’s agreement to all of the contest rules as set forth herein. Applications of minors not including the signature of a parent or legal guardian will not be considered. The contest is void where prohibited by law.

 

Current employees, officers, directors and agents of Sponsor and their immediate family members (defined as spouse, parents, siblings and children) are not eligible to win.

  1. HOW TO ENTER: To enter, beginning August 1, 2017, go to  http://www.apumusiccontest.com and follow the instructions there for completing the Application and uploading your Submission. To enter by mail, forward the completed Application form and Submission in an envelope (packaged carefully so it won’t be damaged) with proper postage affixed, to the following mailing address:

Applications must be submitted by email or postmarked no later than Friday, December 1, 2017, 11:59 PM Pacific time. No exceptions will be made to submit past this deadline.

 

Limit one (1) Application and Submission per person, per category. A student may submit compositions in up to two (2) categories. The five categories are symphonic band or wind-ensemble, orchestra, jazz band (big band), choral and chamber (which includes solo instruments as well as duos, trios, quartets, quintets, etc., as detailed at http://www.apumusiccontest.com). See also instrumentation specifications at that website.  All Applications and Submissions become the property of the Sponsor and will not be returned, although entrants retain ownership of their compositions and demo recordings. Sponsor assumes no responsibility for lost, late, misdirected, or unintelligible entries. By submitting an Application and Submission, you fully and unconditionally accept and agree to these Official Rules and the decisions of the Sponsor, which are final and binding.

Previous winners of this contest will not be considered in the same category, but may submit up to two compositions in other categories. Compositions that have won another national contest should not be submitted, and will be disqualified if the judges become aware of the piece winning a previous national contest.

Azusa Pacific University School of Music and J.W. Pepper Music are looking for compositions that are performable by reasonably well-developed high school ensembles.

Submissions must follow the guidelines described at http://www.apumusiccontest.com at the “About the Contest” tab and the “How to Submit” tab. No purchase is necessary to participate in this contest.

 

 

  1. SELECTION OF POTENTIAL WINNERS: Sponsor is looking for Submissions that are well-constructed, creative, and performable by well-developed high school ensembles. On or about Jan 15, 2018, the panel of judges will select up to three (3) finalists (potential winners) in each category. It is the intention of Sponsor to notify winners by Feb 1, 2018. The decision of the judges is final. Sponsor reserves the right to declare no winner in any category. Notification may be by telephone, email or US mail. The winners will also be announced on the contest website.
  2. PUBLICITY: By submitting an Application and Submission, Applicant (or, if a minor, his/her parent or legal guardian) agrees that Sponsor may, without any limitation or further compensation or notice, use his or her name, voice and/or likeness in any and all media, worldwide, for the purpose of advertising and promoting the Website, the Sponsor, or the High School Composition Contest.
  3. OWNERSHIP: By submitting an Application and Submission, Applicant (or, if a minor, his/her parent or legal guardian) grants to Sponsor a worldwide perpetual non-exclusive license to use, reproduce, distribute and exploit the material submitted, including the worldwide copyright and any extensions, renewals, revivals, reversions and restorations thereof, for any educational, promotional or other non-commercial purpose, including, but not limited to, promotion of the High School Composition contest. Applicant further agrees that Sponsor and its designees may edit and modify the Submission and all elements of it in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to Applicant or any third party. Notwithstanding the foregoing, Applicant shall be entitled to terminate the license granted to Sponsor hereunder upon written notice to Sponsor after a period of five (5) years from the date Applicant submits the Application and Submission.

Applicant retains ownership of the composition and demo recording that make up the Submission, granting only those rights described in the preceding paragraph.

Any recordings made by Azusa Pacific University of APU School of Music performances of winning Submissions are the property of Azusa Pacific University. Azusa Pacific University grants to Applicant a worldwide perpetual non-exclusive license to use, reproduce, distribute and exploit the APU School of Music recording of the Applicant’s winning Submission for promotional or commercial purposes.

  1. PRIZES

The five categories of the contest are wind ensemble, orchestra, choral, jazz ensemble (big band) and chamber.

Three winning pieces will be selected from the categories above. The prizes for winners will be:

  1. i)  $1000 cash payable by Azusa Pacific University
  2. ii)  Public performance and recording by the appropriate Azusa Pacific University music ensemble.

iii)  Consideration for publication by J.W. Pepper and its publishing arm, Wingert-Jones Publications.

  1. iv)  A complimentary subscription for J.W. Pepper’sMy Score®self-publishing platform, valued at $99.

Finalists (up to three in each category of composition) will receive a complimentary subscription for J.W. Pepper’s My Score® self-publishing platform, valued at $99.

Sponsor reserves the right to declare no winner in any category.

  1. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each person who enters the Azusa Pacific University/J.W. Pepper High School Composition Contest represents and warrants: (i) to Sponsor that the Application and Submission are the Applicant’s own original, previously unpublished, and previously unproduced work (except for any performance of the Submission by a school or community music ensemble for the purpose of creating a recording to include with the Submission, whether or not in public concert); (ii) the Application and Submission neither infringes upon nor violates the publicity, privacy or intellectual property rights or other rights of any other person or entity; (iii) the Application and Submission meets the Official Rules set forth herein. Each Applicant hereby agrees to indemnify and hold the Sponsor harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of Applicant hereunder.
  2. NOTIFICATION OF WINNERS: Becoming a finalist is subject to verification of eligibility, including status as a sophomore, junior, or senior in high school, and compliance with all the terms and conditions set forth in these Official Rules. Notification of winners may be by telephone, email and/or US mail.
  3. NO OBLIGATION TO USE: Sponsor shall have no obligation (express or implied) to use any winning Submission, or to otherwise exploit a winning Submission or continue the development, production, distribution or exploitation thereof, and Sponsor may at any time abandon the use of any winning Submission for any reason, with or without legal justification or excuse, and the Contest prize recipients shall not be entitled to any damages or other relief by reason thereof. Sponsor’s sole responsibility is to provide the prizes listed for winners.
  4. LIST OF WINNERS AND THEIR COMPOSITIONS: The names of the Contest finalists and their Submissions, including visual and/or audio excerpts thereof, may be posted on Sponsor’s Websites.
  5. SPONSOR: The Azusa Pacific University/J.W. Pepper High School Composition Contest is sponsored jointly by Azusa Pacific University and J.W. Pepper Music.
